About these terms

These Terms and Conditions apply to services provided by Human Symmetry, including individual sessions, online sessions, workplace sessions, talks, programmes and other agreed services.

They also apply to your use of the Human Symmetry website.

Additional terms may be included in a proposal, quotation, booking confirmation or other written agreement. Where additional terms have been specifically agreed for a particular engagement, those terms will apply alongside these Terms and Conditions.

03

Human Symmetry services

Human Symmetry provides expert-led services relating to movement, mobility, posture awareness, physical resilience and healthy ageing.

Services may include:

  • individual movement and mobility sessions;
  • online or in-person sessions;
  • workplace mobility sessions;
  • corporate talks and lunch-and-learns;
  • workplace movement programmes;
  • MobilitySpan talks and related educational sessions;
  • corporate wellbeing events;
  • tailored organisational programmes; and
  • other services agreed directly with Human Symmetry.

The exact nature, format, duration and scope of a service will be agreed with the individual or organisation concerned.

04

Human Symmetry is not a medical service

Human Symmetry provides movement, mobility and educational services. Human Symmetry is not a medical practice, physiotherapy service or healthcare provider.

Information or guidance provided by Darryl does not replace diagnosis, treatment or advice from a doctor, physiotherapist or other appropriately qualified healthcare professional.

Where appropriate, you should seek medical or professional healthcare advice before participating in physical activity or where you have concerns about an injury, health condition or symptoms.

05

Individual sessions

Individual services may be provided in person or online as agreed at the time of booking.

Individual sessions are generally invoiced or paid for after delivery unless another payment arrangement has been agreed.

Appointment times are reserved specifically for the client and the cancellation terms below therefore apply.

06

Prepaid blocks

Human Symmetry may offer prepaid blocks of sessions.

A prepaid block represents a committed programme of sessions and is normally paid for in advance.

Prepaid blocks do not have a fixed expiry date unless a different arrangement is specifically agreed. Clients may pause and return to their remaining sessions, subject to Darryl’s availability.

Once any applicable statutory cancellation or cooling-off period has passed, a prepaid block is not refundable simply because the client changes their mind or decides not to continue.

Unused sessions remain available to the client subject to these terms and Darryl’s availability.

07

Corporate and organisational services

Corporate services may include online sessions, talks, workplace programmes, events, on-site services and tailored engagements.

Unless otherwise agreed in writing, corporate engagements require:

  • 50% of the agreed fee to confirm the booking; and
  • the remaining 50% on or before the first delivery date.

Human Symmetry may agree different payment stages for larger or customised engagements. Where this happens, the agreed proposal or booking confirmation will take precedence.

08

Cancellations and rescheduling

Individual sessions

An individual session may be rescheduled without charge where at least 24 hours’ notice is provided.

Where less than 24 hours’ notice is provided, or a client does not attend a scheduled session, the full session fee may be charged.

Where the booking forms part of a prepaid block, a cancellation with less than 24 hours’ notice or a non-attendance may count as a used session.

Human Symmetry may exercise discretion in genuine exceptional circumstances.

Corporate sessions

A scheduled corporate session may normally be rescheduled where at least 24 hours’ notice is provided, subject to Darryl’s availability.

Where less than 24 hours’ notice is provided, where participants do not attend, or where the organisation is unable to provide agreed access or facilities, the scheduled session may remain fully chargeable.

09

Cancellation of a corporate engagement

Where an organisation cancels an entire engagement before delivery begins, the 50% booking payment is normally non-refundable, subject always to any rights or remedies that cannot legally be excluded.

The organisation will also be responsible for any non-refundable third-party costs that Human Symmetry has reasonably committed to in connection with the engagement.

Where an engagement is cancelled after delivery has begun, the organisation will be responsible for:

  • work already completed;
  • sessions already delivered;
  • reasonable committed costs;
  • non-refundable third-party expenses; and
  • other reasonable losses arising directly from the cancellation.

Human Symmetry will take reasonable steps to reduce avoidable losses.

10

Health and participation

Participants are responsible for informing Human Symmetry of information that may be relevant to safe participation, including injuries, pain, health conditions, physical restrictions or other relevant circumstances.

You should work within your own comfortable range and should stop an activity if you experience unexpected pain, dizziness, significant discomfort or other concerning symptoms.

If you are unsure whether an activity is suitable for you, you should seek appropriate medical or healthcare advice.

11

Online sessions

Online sessions may be delivered using Google Meet or another agreed platform.

Participants are responsible for ensuring that they have a suitable internet connection and a reasonably safe space in which to participate.

Many Human Symmetry workplace sessions are specifically designed so participants can join from their normal working environment without specialist clothing or equipment.

12

Changes made by Human Symmetry

Human Symmetry may occasionally need to change an agreed date, time, delivery format or other arrangement because of illness, travel disruption, technical problems or other circumstances outside reasonable control.

Where this happens, Human Symmetry will make reasonable efforts to notify the client promptly and arrange a suitable alternative.

If Human Symmetry is unable to provide a paid service and no reasonable alternative can be agreed, any amount paid specifically for the undelivered service will be refunded where appropriate.

13

Fees and payments

Fees will be confirmed before a service or engagement begins.

Where a proposal or quotation is supplied, the fees and payment schedule stated in that document will apply.

Clients and organisations are responsible for paying invoices by the stated due date.

Where additional work is requested outside the originally agreed scope, Human Symmetry may provide a revised quotation or agree an additional fee before carrying out that work.

14

Travel and additional costs

Where an engagement requires travel, accommodation, venue hire, equipment or another third-party cost, this will normally be agreed with the client or organisation in advance.

Reasonably incurred and agreed additional costs may be charged separately from the service fee.

15

Responsibility and liability

Human Symmetry will provide services with reasonable care and skill.

Movement and physical activity involve individual variation. Human Symmetry does not guarantee a particular physical, health, mobility, performance or pain-related outcome.

Human Symmetry is not responsible for loss or damage arising from inaccurate or incomplete information supplied by a client or participant, or from a participant acting contrary to reasonable guidance provided during a session.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including any rights or protections that cannot legally be excluded.

16

Results and outcomes

Human Symmetry’s approach is individual and depends on factors including participation, consistency, personal circumstances and the nature of the work being undertaken.

Examples, testimonials or client experiences do not constitute a promise that another person will experience the same outcome.

17

Intellectual property

Unless otherwise stated, Human Symmetry owns or controls the intellectual property in its original materials, presentations, programme content, written resources, frameworks and website content.

Materials supplied to a client or organisation may be used internally for the purpose for which they were supplied but may not be copied, republished, sold, adapted or distributed commercially without prior written permission.

Human Symmetry retains all rights in the Human Symmetry name, brand materials and proprietary concepts, including MobilitySpan.

18

Consumer cancellation rights

If you are a consumer booking a service remotely, you may have a statutory right to cancel the contract within 14 days, subject to the applicable legal rules and exceptions.

If you ask Human Symmetry to begin providing a service during a statutory cancellation period, you may be required to pay for services properly provided before you cancel.

Where a service has been fully performed during the cancellation period at your express request and with the acknowledgements required by law, your statutory right to withdraw may end once the service has been fully performed.

Nothing in these Terms and Conditions reduces any statutory consumer rights that apply to you under Irish or European Union law.

19

Human Symmetry aims to keep the information on this website accurate and useful, but website content is provided for general information and educational purposes.

Website information should not be treated as individual medical, healthcare or therapeutic advice.

20

The Human Symmetry website may contain links to third-party websites or services.

Human Symmetry does not control third-party websites and is not responsible for their content, availability, security or privacy practices.

21

Privacy

Human Symmetry processes personal information in accordance with its Privacy Policy.

You can read the Privacy Policy at: humansymmetry.co/privacy-policy/

22

Governing law

These Terms and Conditions are governed by the laws of Ireland.

Nothing in this section affects any mandatory consumer protections or jurisdictional rights that apply under Irish or European Union law.

Where possible, Human Symmetry and the client will first try to resolve any disagreement directly and reasonably.
